Drugs and Alcohol at Work - Health & Safety Implications in the Workplace from EAP Institute

EAP Institute The Safety, Health & Welfare at Work Act 2005 came into effect on 1st September 2005 and from that date an employee is not to be under the influence of an intoxicant (defined as drugs or alcohol) to the extent that he or she is in such a state as to endanger his or her own safety, health or welfare at work or that of any other person. Following the introduction of the 2005 Act and in response to queries as to what action employers should take when the Act became law; the following information appeared on the Health and Safety Authority website. “From the 1st of Sept 2005 Employers may prevent an employee from working if he or she would be a danger to themselves or others due to being under the influence of an intoxicant (defined as drugs or alcohol) Guidance on intoxicants (including testing) is currently being prepared by the Health and Safety Authority and is expected to be published in 2010.
